TheConfetti Battle which takes place over the Carnival weekend is a popular localtradition that has been taking place for many years, and one in which everyonecan take part.

TheDevizes Carnival Parade is a spectacular event and promises to be even morespectacular this year marking its 100^th anniversary. The paradestarts on the green and goes through the town centre. A free community costume making workshop hasbeen available to anyone wanting to build a float or take part in the Parade!

AN INTERESTING CASE

NOT EXACTLY A BARREL OF FUN OR LAUGHS

ABD Personal Injury Team is always on the case. Rachel Fereday P I solicitor who is based at the Devizes office was approached by Mr X to help. This case was initially a personal injury case for an accident at work…

It all started when Mr X was working at a bingo club in Manchester. The club ran out of beer, so they arranged for one to be delivered from one of their other clubs in the area which arrived by taxi. Mr X was asked to help his manager lift the full beer barrel out of the taxi which was awkward and extremely heavy. In doing that, together with the act of subsequently needing to tilt the barrel to move it into an upright position, he injured his back.

His back strain then developed into an epidural abscess which required surgery. Mr X was left with ongoing back pain, loss of feeling in his feet, needing to use a wheelchair the majority of the time and essentially needing “round the clock” care from his wife. He was only 29 years of age at the time of the accident.

The claim against the employer was initially fiercely defended but Rachel kept the pressure on and eventually the employer conceded primary liability.

During the course of obtaining expert evidence on Mr X’s injuries, the issue of clinical negligence was raised. The expert opinion was that on admission to hospital with the clinical signs that he had, Mr X should have been referred to a specialist unit within 12 hours but instead that was not done for 5 days. Expert opinion was that if treatment had been instituted sooner his long term outcome would have been better.

The Hospital NHS Trust was therefore joined to the court proceedings.

There were several experts involved in the case who agreed that Mr X should have been referred to the specialist unit within at most one day and that had treatment been instigated sooner his long term outcome would have been better.

A care report was obtained to assess Mr X’s position and what aids and equipment could be purchased to improve his quality of life. A pain management report was also obtained to see if treatment could improve his levels of pain and/or help him cope with it.

A date was set for a 3 day Trial to start but, shortly before this, a meeting took place between the legal representatives for the 3 parties in which a settlement was negotiated at £410,000 for Mr X. This settlement was paid partly by the employer and partly by the NHS Trust.

The compensation agreed included the cost of future care that Mr X needed for the rest of his life, equipment and aids (e.g. purchase and maintenance of wheelchairs etc), loss of earnings and the cost of pain management to help him cope with his ongoing pain.

So, thanks to Rachel’s persistent efforts, this compensation can now be used to improve the quality of Mr X’s life.

A CHRISTMAS CHEER!

Last Friday night was a really great evening...

ABD staff from all the offices (Devizes, Calne, RoyalWootton Bassett and Marlborough) got together and enjoyed their annual“Christmas bash” which took place in the Bear Hotel, Devizes this year.

It was a great eve, everybody was in excellent festive form,and the party didn’t finish until the early hours of the followingmorning! Just as well it was on a Fridaynight!

87 people sat down to eat. AndrewDouglas and Dave Turley handed out raffle prizes just before coffee and mincepies arrived. Then it was back to the bar, catching up on news, and disco!

The morning began with coffee and first class seminar programmes discussing “Future of Estate Agency” as well as demonstrations showing the latest technology and innovations from many exhibitors including Rightmove.

Drinks reception with canapés followed by a “Gala Luncheon” providing the very best of fine food and wine took place early afternoon enabling everybody to settle down and listen in anticipation to The Award Categories Ceremony. This was hosted by Lucia Coward and presented by Ben Fogle. Ben Fogle for those of you who may not know or remember captured viewers’ hearts on BBC millennium project called”Castaway”. He has recently finished filming a Year of Adventures for BBC Worldwide and Lonely Planet to be televised in 2012.

ABD Probate Team joined forces recently with Chilvester Independent Investment Consultants and Financial Planners to present 2 seminars. The first was based at Marsh Farm Hotel, Royal Wootton Bassett, Wiltshire, and the second was based at The Corn Exchange, Devizes, Wiltshire. The purpose of the seminars was to discuss the topics surrounding Planning for Long Term Care in later life.

The seminars were extremely well attended and created much interest.

ABD ENTERTAINS…

Saturday, November 5th 2011 was the date, the weather was grey but not raining and all the guests had arrived.

ABD Partners Tony Awdry, Alistair Everett, Andrew Douglas, Roger Chadwick and also Commercial Solicitor Richard Bowater, Conveyancing Manager Ronna Turley and Trainee Solicitor Joe Phelan had invited their guests to watch the Avivia Premiership Rugby Match at The Recreation Ground in Bath.

THE BIG MATCH

Bath v Harlequins. It was a sell out! Bath against top of the table Harlequins! There were no tickets left to watch this match! 12,200 people attended! It was going to be a cracking game!

Lunch was served in The Illustrious Suite as the guests chatted and waited in anticipation for the game to start…

As a special treat before the match, and with the help of the corporate team at Bath Rugby, ABD had a Bath team shirt signed by all the players. Also, in an exclusive raffle, ABD guests raised £155 for the shirt which was presented to the winner – Strakers Estate Agents Managing Director Antony Bulley by Bath and England prop David Flatman, the monies going to the Bath Community Foundation.

KICK OFF!

Harlequins made a bit of a slow start as Bath began the game on the front foot attacking Harlequins defence in every which way. As time went on though Harlequins eventually assumed control of the contest as they gained the upper-hand at the scrum, line out and breakdown.

At half time the score was 7 – 13 to Harlequins.

As the game resumed with the start of the second half, Bath Rugby were unable to halt Quins’ winning run. There were “fireworks” 10 minutes into the second half as a result of “fisty cuffs” following which “Quins” were awarded a penalty.

THE FINAL SCORE

The final score was Bath Rugby 13 – 26 Harlequins.

A fantastic and exiting game enjoyed by all ended with tea and cake back in the Illustrious Suite. Then it was home for fireworks and bonfire night!

HAPPY TO LIVE IN DEVIZES!

ABD PARTNER ROGER CHADWICK PASSES COMMENT...

Devizes Community Area Partnership (DCAP) is a body which links local government with local businesses, the community and statutory bodies such as the police and NHS.

One of the Partnerships aims is to create a Strategic Area Plan for the Devizes Community Area and to set out what services and facilities will be needed over the next 15 years. For example how many schools, roads, hospitals, sports facilities etc will be required.

LIVING IN THE DEVIZES AREA

In order to gauge people’s needs, DCAP sent out a questionnaire to 11,500 households in the Devizes Community Area and to their surprise received 3,000 responses back!

Because the response was such a positive one, not only did the local press write an article about it but also ITV wanted to do a short interview.

ABD Partner, Roger Chadwick who is Chairman of DCAP agreed to the interview which took place at ABD’s Devizes offices recently.

WILL PLANNING – ONLINE ASSETS.

“Pass on your digital footprint in a will, urge lawyers”. (The Times, October 12 2011).

ABD is to start actively encouraging their clients when making a Will to decide on what they would like to do with their web based assets and “online life”.

In the same way that clients keep details of their investments, bank accounts, savings and assets etc, ABD will start to advise and recommend that clients keep details of their “online life and assets” to incorporate into their wills.

Many social networks, email providers and online account companies depending on their terms and conditions either grant differing levels of access, or refuse to disclose usernames/passwords/logins etc altogether to the next of kin, making it extremely difficult for them to access, deal with and close the deceased accounts.

ENTRUSTING YOUR PASSWORDS.

Clients are now starting to realise that by leaving details of their passwords/usernames/logins etc of their online accounts in their wills, it makes it much easier for their next of kin to have access and to deal with these accounts after death in the necessary way with help and advice from their solicitor.

Janice Leyland who has recently started in ABD’s Family Law Department.

Janice is married with 2 grown up children and previously worked for a law firm based in Gloucestershire where she specialised in family law.

Her role within ABD is to assist in the steady development of this very busy vibrant department which is based at the Devizes office. She will also be visiting ABD’s Calne office on a regular basis to meet clients and discuss any matters relating to family law.

‘ROYAL’ WOOTTON BASSETT

“We honour those who serve”

(Royal Wootton Bassett motto).

Wootton Bassett Town is known as, and will always be remembered for, being a stronghold for community and support during the countless repatriation ceremonies that have taken place since 2007. In recognition of this the Town has been granted the title ‘Royal’. The official unveiling of the new Royal Wootton Bassett road sign by Mayor Paul Heaphy, and Jane Scott, Leader of Wiltshire County Council, took place last week.

“This Community has come together in the most extraordinary way”(The Princess Royal).

Thousands of people turned out to line the town's High Street for the remaining ceremony which took place on Sunday 16th October 2011 whereby The Princess Royal presented the Letters Patent on behalf of Her Majesty the Queen. The Town being granted the title ‘Royal’ is a rare honour which was last bestowed on Tunbridge Wells, Kent in 1909.

The Prime Minister David Cameron also attended. He stood beside new Defence Secretary Philip Hammond as they witnessed the march-past by units representing the 3 services. The march-past was led by the band of the Royal Marines playing a piece of music entitled ‘Wootton Bassett’ as they took just 350 steps to the Viewing Stand in representation of the number of bodies driven along the very same route. The piece of music was written by Captain Pete Curtis – a Royal Marines director of music.

There were also flypasts by a C130 Hercules, a giant RAF C-17 Globemaster aircraft, and a Vulcan Bomber – all planes which were important to nearby RAF Lyneham and Royal Wootton Bassets past.

COAT OF ARMS

ABD RECEIVES A PLAQUETTE IN RECOGNITION OF THE NEW COAT OF ARMS!

Also in commemoration of this change, approximately 14 local firms including ABD made a contribution towards the new Coat of Arms which has now been replaced with a gold lion at the bottom of the shield instead of a diamond. This will shortly be on show in Royal Wootton Bassett Town for the public to see.

To thank ABD and the other firms for their contributions, a presentation took place at Marsh Farm Hotel, Wootton Bassett on Friday 14th October 2011. All were invited to attend and each firm received a plaquette. Dr Clive Cheesman, from The College of Arms, London, did a brief talk about the Coat of Arms, its historical facts, and its new design.

ABD Partner Peter Shah accompanied by Solicitor Alex David attended and was presented by Mayor Paul Heaphy with a Coat of Arms plaquette which will be placed in ABD’s Wootton Bassett Office Reception for the public to see!

INVITATION TO “SPEAK” SENT TO CHIEF LEGAL OMBUDSMAN FOR ENGLAND AND WALES - ADAM SAMPSON.

ABD Partner Roger Chadwick who was recently elected to be President for the Gloucester and Wiltshire Law Society will begin his new role in 2012.

IN THE MEANTIME…

Roger has been actively recruiting new sponsors and also new members to help promote and develop the Law Society in becoming a more accessible body.

He invited Adam Sampson to attend Bowood Golf and Country Club to talk about his role as Chief Legal Ombudsman for England and Wales.

Once the legal fraternity had gathered and seated, Adam spoke to an audience of about 70 people who listened to the role of the Legal Ombudsman and why it has been created. He talked about the changing complaints structure, and the purpose of the scheme.

This presentation was well attended from new members to existing members of the Gloucester and Wiltshire Law Society, qualified solicitors, trainee solicitors, legal executives and law students.

MATRIMONIAL DEPARTMENT TEST THE WATERS FOR NEW TIMES AHEAD!

ABD TEAM BUILDING DAY OUT!

A relaxing day out cruising on a canal barge from Hilperton Marina, to Seend for a "lite bite" sounded like a fantastic idea for this hardworking department not only to spend some "time out together" but to also use it as a kind of team building exercise, is exactly what the ABD Matrimonial Department did, and I felt very privileged to go with them...

The ABD Litigation Department had done this very same trip only a few weeks ago for their team building day out which proved to be a great success.

The weather started rather grey and cloudy (the day before had been hot and sunny, oh well,) as we boarded our canal barge for the day which was aptly named "Cheers".

After a complicated and lengthy but very informative "health and safety" talk on boat problems/use of lock key/getting through the locks/making a cup of tea/man over board etc etc from one of the smiley faced barge instructors, we nervously questioned amongst us for a split second whether we were capable and able enough to actually make it in one piece to our destination the "Brewery Inn", a popular inn producing excellent fare and drink based in Seend, Wiltshire.

"Come on team, we can do this!" So off we chugged with ABD Partner Andrew Douglas in the driving seat steering us away.

The journey itself to Seend took no more than approx 4 hours and was hugely relaxing even when it rained and at one stage felt slightly cold out. Most had a go and enjoyed steering the barge. Not an easy thing to do, the barge is a slow mover when steering, and you need to think ahead of the game especially if there is another barge insight heading towards you! The locks are relatively straight forward and require an amount of team strength to open/close the locks whilst you then wait for a few minutes or so for the water to rise. Its also a great way to meet/have idle chit chat to other barge users doing the same especially if they are going in the same direction because 2 barges can wait for the water to rise (or fall) at the same time. Patience, strength and avoiding other objects are key factors all round with this sport!

PATIENCE IS KEY.

It was really good to meet the Matrimonial Department in the flesh so to speak. Chatting, listening and finding out what they were about - This is clearly a solid, and special close nit team of slick mediators who can calmly deal with any given matrimonial situation and achieve the required results. This is a team that deals with people who are going through a very difficult stage in their lives that involve the words separation, divorce, children, family, structure, home, belongings and loss.

WE MADE IT

Finally, we arrived at our destination, the Brewery Inn where we enjoyed very tasty lunches and drink. We were intrigued to note that they provided our food not only on plates but also baking trays and slabs of wood and slate! Very rustico!

The return journey was a deja vu of the locks (in reverse - we had to wait for the water to fall), herons happily perched close by, houses, gardens, wonderfully named, beautifully painted and a few unkempt barges moored up on the canal side. Some had solar panels. One even had a lengthy vegetable plot on its roof-amazing. Its good to see life from a different perspective.

The barge was aptly named "Cheers" which is what we said as we sipped our beers, wine and beverages. As if lunch wasn't enough, we piggishly tucked into further "party" fare as we passed the time of day. The sun even came out briefly!

The journey seemed go slowly yet fly by because it had been such an enjoyable day which had come to end before we knew it. In fact, Janice Leyland, Matrimonial Solicitor based a Devizes Office who had joined the firm the day before was especially impressed with her second day in the office sorry I mean on the barge! As we moored up at the Hilperton Marina and collected our belongings, the unanimous vote that this would become an annual event was an absolute definite thumbs up! Thank you so much for inviting me too. It was great.

ABD PARTNER ELECTED NEW PRESIDENT OF THE GLOUCESTER AND WILTSHIRE LAW SOCIETY!

UNANIMOUS VOTE!

Recently, at the AGM of the Gloucester and Wiltshire Law Society, ABD Partner Roger Chadwick was elected to become the new President. The term of office commences January 2012 and runs for 18 months. Roger is based at the ABD offices in Devizes, Wiltshire and is already working hard and on the case.

Roger who has been on the committee for 2 years already is really excited about his new role of becoming President in 2012.

CHANGES ON THE WAY!

Roger plans to make some significant changes to the way the Gloucester and Wilts operates....

He has already started to actively recruit sponsors which has created really good interest and is working very well.

He is also looking for new members, in particular social members who can attend social networking development functions to not only develop their own businesses, but to also promote the Law Society in becoming a more accessible body.

Roger has invited the Legal Ombudsman for England and Wales Adam Sampson to attend Bowood Golf and Country Club, Calne, Near Chippenham in September 2011 to talk to solicitors about the role of the legal ombudsman and the changing complaints structure.

Adam Sampson was previously Chief Executive of "Shelter" the country's leading housing and homeless charity before he became chief Legal Ombudsman for England and Wales.

The legal ombudsman was established by the Office for Legal Complaints. AN EXTREMELY EVENTFUL DAY COURTESY OF HAMPTONS INTERNATIONAL!

GATCOMBE PARK INTERNATIONAL HORSE TRIALS....

A day to be remembered between sunshine and rain showers- we had an extremely enjoyable day!

ABD Partner Andrew Douglas and his wife Keshani were invited by Andrew Marshall who is Regional Sales Director of Hamptons International to the Festival of British Eventing presented by Gatcombe Park on Sunday 7 August 2011.

The morning started off by meeting other invitees in the Event Hospitality Marquee for coffee, danish pastries and a "catch up" followed by a visit to the trade stand area...

TRADE STANDS GALORE!

YOU WOULD HAVE A FIELD DAY SHOPPING!

From equestrian kit to cashmere clothing. Accessories for dogs to classy picnic hampers and Jacuzzis - it was all there. The Flying Fox provided country & sporting gift collections. The Sock Company Country supplied hosiery for town and country. Of course there was Dubarry of Ireland and Landrover UK. Henry Hunt sold luxury county clothing with height of fashion twist! Whilst Chatham Marine Ltd - one of of the UK's leading marine footwear and clothing brands were "on hand" too. These were just to name but a few trade stands there. The area was packed full of happy shoppers with their dogs in toe! It was a serious shoppers area.

A delicious lunch was served at 12.00 noon which Andrew and Keshani enjoyed followed by welcome and presentation on cross-country course by Captain Mark Phillips.

Princess Anne and her husband also attended lunch and Princess Anne's Son Peter Phillips who came to say hello along with Harry Mead (Richard Meads son).

After lunch the show jumping had just finished and it was time for Zara Phillips to say goodbye to her all time favourite horse "Toytown". Her husband Mike Tindall was there as well as her mother Princess Anne and brother Peter Phillips to watch Toytown in the ring for the last time before he retires - what a beautiful horse he is.

Shetland Pony Grand National was a fun event. The ponies are only 40" high and the jockeys no older than 13 years of age.

DRESSAGE TO MUSIC WAS A MUST TO SEE..

Dressage to music has become hugely popular since its inception as part of the Olympic Dressage programme at the Atlantic Olympics in 1996 and is known as the musical kur. The rider chooses music that fits the paces and personality of themselves and their horse, and they put together a kur that includes all the movements of the Grand Prix. They can ride the movements in any sequence and the more difficult the sequence, the higher the mark - the test is marked 50% for technical merit and 50% for artistic merit.

Such an impressive sight to see. The horse looks so elegant and graceful as it moves in time to the music.

Afternoon tea was served at 4.00pm with delicious cakes and sandwiches.

AREA ATTRACTIONS.

The falconry display was an impressive event. The children as well as adults were enthralled with watching these huge birds of prey with their enormous wing spans flying around.

-Winner of British Eventing Open Championship was Andrew Nicolson who rode on Nereo. Score 29.9.

-Winner of Smith & Williamson British Intermediate Championship was Angus Smales on Clover hero. Score 32.5.

Next year this festival will be moved forward a month so as not to clash with the 2012 Olympic Games.

It was a thoroughly enjoyable day out and thank you so much to Andrew Marshall and the Hamptons team for inviting us.

NO ARGY BARGY WITH ABD LITIGATION TEAM!

ABD LITIGATION DEPARTMENT ANNUAL DAY OUT!

The morning started dull, grey and muggy - almost slightly stormy but the tough Litigation Team didnt care, they were out to enjoy their day come rain or come shine....

Hilperton Marina, Trowbridge was the starting point where they divided into 2 groups and climbed on to their chosen barges which they had hired for the day.

Right then, who is going to be captain? Peter Shah or Peter Johnson? or both?

After a brief litigious lesson on how to steer, health and safety, man over board situation, etc etc, off they went. They were heading for the Brewery Inn at Seend Cleeve for lunch along the picturesque Kennet and Avon Canal.

This is a trip that they have been doing annually and is in its 6th year! Gillian Ephgrave based at Devizes Office has always organised it.

"It is a thoroughly relaxing day and everybody really enjoys it"

Ok ,ok this is a tough job for a litigator!

The journey started around 10 ish and the leisurely trip took about 2/3 hours to get to the Brewery Inn. En route, it rained, but nobody cared because they were hungry and had reached their destination. After mooring up. It was time to eat and good food was enjoyed by all.

The Brewery Inn was originally 2 cottages built in 1847 and converted into an inn in 1859. The name Brewery Inn was first mentioned in 1866. It is a good stop off for canal faring day trippers.

After lunch, the sun looked as though it was trying to come out but it was still very muggy and grey. The canal was busy being height of season and lots of barges about.

That lunch was very filling, shall we walk back to Hilperton or phone for 2 barges?

After boarding the flat bottomed vessels it wasn't time to hit the deck, but it was time to return to Hilperton Marina again.

ABD OFFICES IN CALNE OVERSEES BIG BIKERS CONVENTION ORGANISED BY THE ROTARY CLUB OF CALNE...

The unmistakably impressive pink coloured office building belonging to ABD in Calne (dating back to 1740) stands proudly "surveying" the Calne Rotary Club Motorcycle Meet which took place on Saturday 23 July 2011 throughout the busy town of Calne.

This annual charity event is in its 11th year and attracts thousands of bikers to the town.

ABD team Halina Tomlinson, KJ, Tim Hotchkiss, Joe Phelan , Tom Paget, Peter Johnson and Catherine Cole took time out to man the ABD Stand in the centre of Calne had a great day. WHY? The team are big motorbike enthusiasts! Take for example KJ;-

KJ has been interested in motor bikes since her late teens and used to watch bike racing. Her dad also owned a BSA.

KJ has owned 3 bikes. She started with a Hyosung Cruise 11 124cc (which she called Tom) whilst she was learning to ride. She then progressed to a Honda CBR400 NC23 (which she called Ollie).

When she moved to Devizes with her husband Paul (also a bike enthusiast) she decided with Pauls encouragement that it was time to get another bike so she purchased a Honda CBF 500 (which she calls Biggles) and currently owns. They have never looked back! Both KJ and Paul have been to lots of bike shows throughout the country.

Paul is involved with online radio station BIKERSfm and presents a show on a Monday night based around British Superbike, World Superbike Championship and Support Series which involves interviewing bikers from both British and World Stage.

Friday 15th July saw the opening of the festival at 6pm outside the Castle and Ball Hotel. ABD Partner Andrew Douglas and his wife Keshani were invited to an evening reception hosted by Wiltshire Life Magazine at The Merchant's House, High Street, Marlborough.

ABD Solicitors Alex David, Wayne Elliott, David Kelshall and Tom Paget (Trainee Solicitor)enjoyed a "lads night out" with guests. They ended their evening in the ABD Priory Marquee listening to The Red Stripe Band - "the closest thing to Jools Holland and his Big Band". Marlborough Jazz Brochure.

ABD Partner Roger Chadwick and Susan Fosbery enjoyed listening to the sounds of anglo-american group "Protect the Beat" in the ABD Priory Marquee followed by Robin Jones & King Salsa! Frances Ruffelle Show and Jive Aces completed the evening.

A TOUGH MATCH!

The Wiltshire Golf Club hosted the ABD Ryder Cup against Strakers Estate Agents on 12 July 2011. A competitive and compelling afternoon was enjoyed by all! At the end of the day the magic number was 155 which was the points tally accumulated by Strakers as against ABD's 151.

FRAUD - meaning of - "deceit, impersonation with intent to deceive; criminal deception with the intention of gaining an advantage; a snare; a deceptive trick; a cheat or swindler; fraudulent item".

FRAUDULENT TAX BILL!

An executor acting in the estate of his late Uncle was convicted of fraud after pocketing more than £25,000 for his own use from the estate. He claimed it was needed to pay a tax bill! So he forged the signiture of his co-executor on the cheque. These things really do happen, so the moral to this story is - why not consider appointing a solicitor as a co-executor in your will so that the estate can be dealt with properly and efficiently ........and keep it out of the law courts by contacting our probate department!

HAVE A HEART APPEAL IN SUPPORT OF CHILDREN'S HOSPICES UK.

WELL DONE and MANY CONGRATULATIONS to Catherine Cole who ran in the Reading Half Marathon on Sunday 20 March 2011 in support of CHILDREN'S HOSPICES UK.

Have a Heart Appeal is run by Heart FM. This year they are supporting Children's Hospices UK by raising money to provide care and support to local seriously ill children and their families in their own homes, as well as providing care and support for the seriously ill child. A visit from a hospice nurse can also relieve the pressure on the family allowing them to spend more time with their other children.

Catherine who is a legal assistant, and is based at ABD's Calne office works for the Probate Department. Catherine started running about a year ago and says she "loves it and has the running bug!" So far, she has competed in various 5k and 10k races locally.

Catherine's training for the Reading Half Marathon was a tough one! She started her training in the cold month of January up until the week of the race by running at least 4 times a week. A lot of people took part in the race. There were over 18,000 people running this year. The route was predominately road based around the streets of Reading Town Centre finishing in the Madjeski Stadium. Catherine completed the run in 2 hours and 6 minutes which was fantastic! She even sprinted to the finishing line! All her training was worthwhile.

With support from work colleagues, family and friends she has raised over £350 (plus gift aid) in support of Children's Hospices UK.

Catherine hopes to enter the Chippenham Half Marathon in September 2011.

So, many congratulations, and good luck for your next race. We know you will enjoy the training..

David Cameron Prime Minister announced today during Prime Minister's Questions.....

Wootton Bassett is the first town in more than 100 years to be granted the title 'ROYAL' in recognition and as a tribute to the countless repatriation ceremonies that have taken place since 2007.

Wootton Bassett lies on the route the corteges currently take from RAF Lynham to the John Radcliffe Hospital in Oxford bringing out 100's of people not only from Wootton Bassett but also the surrounding districts. People have come out in all weathers to pay their respects as the town comes to a standstill to sadly watch the fallen heroes that pass slowly by on their last journey, the families these heroes have left behind and also to the armed services.

"The Queen had agreed to the tribute as an endearing symbol of the Nation's admiration and gratitude to the people of that town."

Wootton Bassett is Britain's third ever 'Royal' town.

Leamington Spa was granted the title 'Royal' in 1838 by Queen Victoria.

Tunbridge Wells was granted the title 'Royal' in 1909 by King Edward VII.

Both these Spa towns had petitioned for honour in recognition of their antiquity and Royal patronage of their facilities.

There are also a number of 'Royal Boroughs' in England.

Greenwich will become a 'Royal Borough' in 2012 in honour of the Queen's Diamond Jubilee.

Caernarvon in Wales was made a 'Royal Borough' by the Queen in 1963 and was allowed to retain the honour when it ceased to be a 'Borough' in 1974.

Troop repatriation will no longer continue via Wootton Bassett when RAF Lynham closes, but until such times, the staff who are based at ABD's Wootton Bassett Office, and many others, will continue to show their respects as fallen heroes pass by.

AN UNUSUAL CASE

NEW CAR FOR OLD?? - BIG TROUBLE!

Miss J traded in her old car and purchased a brand new one from a dealership in September 2009. she took advantage of the government scrappage scheme. Miss J immediately noticed that there appeared to be excessive condensation in the vehicle and raised this issue with the sales team on the handover checklist. Shortly thereafter a serious leak also developed in the rear footwell and the condensation worsened, especially in the colder weather. As a result, she made it clear that she wished to reject the vehicle under the Sale of Goods Act 1979.

The dealership insisted that tests and repairs should be carried out before they could consider a formal rejection of the vehicle. A number of repairs were carried out on the vehicle throughout 2010 and Miss J was offered as a goodwill gesture the sum of £500.

Unfortunately, the issue of the excessive condensation and damp continued and Miss J reiterated her request to reject the vehicle in May 2010. The dealership insisted that the vehicle was of satisfactory quality and continued to insist on further tests and repairs. As the weather began to get colder, ice started to form on the inside of the vehicle as a result of the defects.

Miss J by this stage had had enough and decided to seek legal advice in December 2010 from Tim Hotchkiss who is based at ABD's Wootton Bassett Office. Tim is a Fellow of the Institute of Legal Executives and specialises in Consumer Disputes. Tim sent a letter before action to the dealership making it clear that the vehicle was not of satisfactory quality and that it was deemed to be faulty at purchase. This was because Miss J had found faults with the vehicle within 6 months of purchase. Tim quoted and relied on all appropriate Statute and Case Law to support Miss J's claim.

Following a productive meeting with the dealership, it was agreed that Miss J would accept a brand new '60' plate vehicle with higher specifications. This agreement included a 3 years manufacturers warranty and half a tank of fuel to cover travel expenses. This result was far more beneficial financially that a straightforward refund.

This case is considered to be unusual in that Tim was successful in negotiating a replacement vehicle some 15 months after purchase and Miss J was VERY happy indeed with the outcome.

ABD is likely to have one of the longest lines of succeeding partners in the Country whereby you can trace the firm back to as early as 1750. They have also acted for a distinguished line of clients who can be traced back to 1804 and earlier!

We are busy creating a time line which will show you the history of the firm and will be on our website for you to see.

The firms original founder was William Salmon (1) who started out in Devizes as a young attorney and was the first of 3 generations of attorneys who served successively as Town Clerk to the Borough of Devizes. He started the firm in 1750. He was then joined by his son William Salmon (2) a shrewd and successful man who owned most of Devizes Castle in 1809 and was known in Devizes as "King" Salmon because not only did he have a successful law practice but he also became a partner in Devizes' first bank called Salmon Tylee and Co.

Henry Addington around the same time was the first British Prime Minister to emerge from the middle classes. He was the son of Doctor Anthony Addington, a leading Physician who had treated King George III. He joined the Government and served under Pitt The Younger. Soon after, he secured a seat in the Commons as the Member for Devizes, Wiltshire. In March 1801 Henry Addington became Prime Minister and Chancellor of the Exchequer. He also had family connections in Devizes. It was during this period that Salmon and Son acted for Addington in various legal and business matters.

MERRY CHRISTMAS EVERYONE!!

A huge thank you goes to ~Andrew Douglas, Tony Awdry and Alistair Everett for providing a really enjoyable Christmas Party at the Bear Hotel last week. Approx 100 people gathered which was great to see!

The evening started with a glass of Christmas Cheer upon arrival and a catch up.

Cheers! Smartly dressed for the occasion!

Time to eat! Everyone sat down to enjoy a 3 course meal followed by coffee.

Ok, which table are we on?

Uh oh.. water water everywhere and not a drop to drink!! Ian and Rachael sharing a joke.

"Would you like some water Rachael?" Ian asks "No thanks I've just had some!" replies Rachael mopping her dress and the table.

Before the first course heads and tails were played and thereafter timely speeches were made!!

Some great prizes were won in a raffle. Grace was given by Joe Phelan, and everyone tucked into their christmas food.

AFTERWARDS tables were cleared for a 10 piece band to assemble, and dancing began!

For those that didnt want to dance it was a great opportunity to catch up on news and have a good time!

TEAM EFFORT!

The pink ribbon is an international symbol of breast cancer awareness.... it is also used by legal firms to tie up a brief for delivery to a barrister!!

Each October - breast cancer awareness month - hundreds, if not thousands of products are emblazened with pink ribbons, or coloured pink.

People raise money by organizing different activities such as "Pink Day"whereby each employee wears an article of pink clothing, ribbon or accessory at work to signify their intention to support/raise money in aid of breast cancer.

Talk about team effort, a VERY BIG THANK YOU goes to Claire and Liz from ABD's Accounts Department for organising once again "dress down day including something pink." This was in support of breast cancer charity which took place on 29th of last month! All the office staff took part! THAT IS - Devizes, Calne, Wootton Bassett and Marlborough Offices! Its the taking part that counts!!

Their day not only included dressing down and wearing something pink, for £2.00 each, but also a buffet lunch whereby each employee provided food and everyone ate a plate of lunch for £1.00! a tombola, a raffle, cakes were made for sale and more!!

At the end of the day, an amazing total of £197.60 was raised! These proceeds will go towards helping to find a cure, breast cancer care, or research programmes.

As for the historical lawyers pink ribbon, that will just continue to tie up briefs!!

A WORTHWHILE CASE.

Mesothelioma - meaning - "a malignant tumour of the lining of the chest or abdomen often caused by
asbestos dust".

Mr X had been employed by Islington Borough Council as a Clerk of Works. His job was to oversee the removal of asbestos from Council owned properties which he did for approximately 10 years. He then retired.

20 years later, he began to develop shortness of breath followed by a variety of other unpleasant symptoms that became increasingly more unpleasant and also painful

He had contracted MESOTHELIOMA

Sadly, he died 5 months later after diagnosis.

HIS WIFE AND FAMILY WERE DEVASTED...

Some months later after much discussion, his family decided to contact Peter Shah -Personal Injury Lawyer and Partner at ABD. They wanted to know whether they should sue because they were extremely unhappy with how and why Mr X had died. They felt that Islington Borough Council were to blame.

Peters job was to claim compensation for the loss of a loved one.

After a period of time, as a result of Peters hard work, an out of court settlement was finally reached with the Councils insurers. Mr X's family received £80,000 and Islington Borough Council admitted defeat.

Mr X's wife and family were extremely happy with the outcome that Peter had achieved for them and they felt that justice had been done.

A very worthwhile case.

TEAM EFFORT!

In aid of British Heart Foundation!

Many congratulations to Sharon Mann who ran the Swindon Half Marathon on Sunday 10th October 2010 in aid of British Heart Foundation

Sharon, who is based at ABD's Calne Office and is part of the Litigation Department, came 357th out of about 1513 who were running! It took her 1 hour 44 min's and 29 seconds (chip time)... very impressive! She was presented with a medal and T Shirt at the end of her challenging run.

Sharon has run a couple of half marathons before but never for charity like this one. So far with the kind help of her work colleagues, friends and family who have sponsored her, she has raised for charity approximately £120 with more money to come!!

Her training prior to the half marathon, involved long distance running with her husband during weekends and shorter maintenance runs during the week. This was just as well because the course was a tough one with a few hills!!

She is hoping to continue running more half marathons and possibly even a full marathon!

So, after having had some leg rest she is now back on the training and working out her next challenge!

BUSINESS COMES FIRST!

Devizes Chamber of Commerce gathered in the Bear Hotel, Devizes to enjoy their annual dinner on Friday 15 October 2010!

The dinner was attended by local business committee members including ABD Partner Roger Chadwick. Also in attendance was ABD Partner Andrew Douglas.

Guest Speaker for the evening was Claire Perry, Conservative MP for Devizes.

Richard Jaggs, Devizes Chamber of Commerce Committee Chairman gave a speech followed by guest speaker Claire Perry MP.

After a question and answer session the evening ended with coffee, chocs and carriages home!

The Honeystreet villagers were granted a big Lottery Fund Grant of £273,840 in order to preserve their local pub ."The Barge Inn Community Group" are the new tenants of the Barge Inn at Honeystreet.

Featured already on Local TV News and to be featured in a BBC ONE TV Documentary, the villagers have bought the 200 year old Inn.

The Barge Inn is located on the banks of the Kennet and Avon Canal and is the
headquarters of the crop circle fraternity - the hub of crop circle enthusiasts!!

The weather looked set for sunshine all afternoon as the four balls played the Course and entered various mini competitions in aid of the Help for Heroes Charity en route! Refreshments were on hand the half way house!

Back at the Clanmaurice Room the tables were set for an enjoyable evening!

After a long afternoon out on the Course the Groups came in after having enjoyed their game. Pre drinks were on hand at the bar after such thirsty work!

A GREAT KICK OFF!!

Saturday morning ( 11.9.2010) "kicked off" with ABD Team Andrew Douglas, Alistair Everett , Roger Chadwick, Ronna Turley ,Kathryn Roker and Rebecca Vassie meeting their guests at the Bath Rugby Club to watch Bath Rugby Club v London Irish!

TEAM BUILDING FUN!

The PI Team once again enjoyed their annual barge trip "team building" get together on the Kennet and Avon Canal organised by Gillian Ephgrave from the Devizes Office.

The team consisting of 16 people took 2 barges and sailed from Hilperton Marina to Seend Cleeve where they moored up for an enjoyable and tasty lunch at the Barge Inn Pub!

A good lunch was had by ALL!

Managing a barge is heavy work - 8 locks and 6 swing bridges had to be opened and closed en route whilst enjoying the wonderful hot sunny weather and fantastic scenery. The whole journey from start to finish took some 6 and a half hours! Thirsty work! Luckily there was plenty of drink on board!

STEERING A DIFFERENT COURSE!

The Partners and Staff held a "farewell party" in the Bear Hotel, Devizes for Commander Ian Richards who has been with the firm for 10 and a half years.

Ian, previously a Commander in the Royal Navy, joined the firm in November 1999 as a "Director of Legal Services". Ian has had many varied responsibilities in his role. Achievements included securing for the firm their Investors in People and Lexcel accreditations and, importantly, steering the business on a safe course through both benign and more troubled economic conditions.

The Bear Hotel which has been recently refurbished by Gordon Straker provided as always excellent food, drink and hospitality! Gifts and cards were presented, and speeches were made by Ken Welch and Partner Andrew Douglas. An enjoyable time was had by all!

The firm wishes Ian every success and happiness for the future!

Newly appointed David Turley has taken over as Ian's Successor. He has enjoyed his new role since April 2010 following a very successful handover period! Solicitors Alex, Wayne and Tom (Trainee) got together with associates to enjoy a night of beers, music and food starting off at the Castle and Ball Hotel where Claire Perry MP "opened" the Festival in the presence of the Mayor of Marlborough, Councillor Andrew Ross. Later, at the ABD Priory Marquee, Chris Jagger , (Mick Jagger's brother) and his band The Atcha Band quintet were playing to a big audience where the boys enjoyed a beer followed by a bite to eat at the Gourmet hot dog stand. After continuing their "sophisticated pub-crawl" the boys ended their musical sojourn by listening to The Red Stripe Band back in the ABD Priory Marquee along with a full house audience - a fantastic way to end the eve!

The Partners of ABD hosted a 2 course lunch in Coles Bar Restaurant for 28 guests whilst listening to The Midwest Four quartet! Guests were then escorted by invitation to the ABD Priory Marquee to listen to The Jive Aces - UK'S No 1 Jive and Swing Band - one of the hottest bands in showbiz. Partners Andrew Douglas, Alistair Everett and Roger Chadwick had their photo taken with The Jive Aces! The ABD Priory Marquee had more than 900 people in attendance! The music continued with Paddy Milner and the Big Sounds, ending with Robin Jones and King Salsa led by legendary conguero Robin Jones!

The Partners of ABD hosted a buffet style lunch at the Castle and Ball for approx 50 guests including the Mayor of Devizes - Councillor Peter Smith and the Mayor of Wootton Bassett -Councillor Mary Champion. Lunch included an enormous paella -a major attraction! Afterwards, guests were hosted to the ABD Priory Marquee to enjoy listening to one of the main highlights of the Festival and direct from the West End, one of the worlds most celebrated Jazz Stars Mr Buddy Greco and his band The Buddy Greco Trio with Miss Lezlie Anders! Buddy Greco is a survivor of Hollywoods famous "Rat pack"! Partners Andrew Douglas and Alistair Everett were photoed with Buddy Grecco after! What a marvellous way to end such a great weekend at the UK's largest and most celebrated Jazz Festivals 2010!
